In a landmark ruling handed down in Paris on 30 June, the giant internet bidding site eBay have been judged negligent in protecting the goodwill and brands of the group LVMH in an action brought by Louis Vuitton Malletier and Christian Dior Couture. This may have a significant impact for the potential sale of counterfeit wines in the future both on internet sites and through more established outlets.

With the 95th General Assembly failing to meet the May 31st deadline for adjournment, Illinois lawmakers enter into an overtime session without calling House Bill (HB) 429. HB 429 is the result of more than a year of negotiations between Groups representing Illinois wineries, out of state wineries, retailers and distributors. The group is calling on the House of Representatives to vote on the bill as soon as possible. HB 429 will allow Illinois to continue to regulate shipments of wine for both in-state and
out-of-state wineries and will bring Illinois into compliance with a May 2005 U.S. Supreme Court Decision.

The Alcohol and Tobacco Tax and Trade Bureau (TTB) published three final rules in the Federal Register establishing nine new viticultural areas. Treasury Decision TTB-50 establishes seven new viticultural areas within the boundary of the existing Lodi viticultural area, which lies within southern Sacramento and northern San Joaquin Counties in California. The seven new areas are Alta Mesa, Borden Ranch, Clements Hills, Cosumnes River, Jahant, Mokelumne River, and Sloughhouse. Treasury Decision TTB-51 establishes the Eola-Amity Hills viticultural area in Oregon. The viticultural area is entirely within the existing Willamette Valley viticultural area and encompasses roughly 37,900 acres within Polk and Yamhill Counties. Treasury Decision TTB-52 establishes the 2,090-acre Saddle Rock-Malibu viticultural area in Los Angeles County, California.

The Alcohol and Tobacco Tax and Trade Bureau (TTB) issued a final rule in the Federal Register adopting a proposed amendment to the regulations pertaining to wine vintage date labeling. The adopted proposal allows (1) wine labeled with an appellation of origin other than a country or viticultural area to bear a vintage date if at least 85 percent of the wine is derived from grapes harvested in the labeled calendar year and (2) retains the current requirement that at least 95 percent of the grapes in a vintagedated wine be harvested in the year shown on the label for wine with an American viticultural area (or its foreign equivalent) as an appellation of origin.
The final rule becomes effective June 1, 2006.
